Civil wars don’t follow a template. Secession is not a necessary condition for an American civil war. In this case, our civil war is over the following political-existential constitutional questions: 2/

a. Whether the executive branch of the federal government is constrained by the U.S. Constitution laws, passed by Congress, and, when necessary, reiterated by the judicial branch.
b. Whether the executive branch may ignore the Constitutionally-defined sovereignty of states. 3/

These are now live issues. The current federal executive has put them into live question by taking the position that the executive branch is not constrained by the Constitution and relevant federal laws and may use militaristic force against Americans to implement its position. 4/

@heidilifeldman I think secession or dissolution will be a post-condition of this civil war… I don’t see the United States surviving this as a unified entity.

@UweHalfHand @heidilifeldman One thing for sure: the old order is gone forever. Either the future will be fascist (followed by extinction), or the people will build a new, post-capitalist world...one with human, humane values, I hope!

Whichever side prevails, a new constitutional settlement will be required. Implementing that settlement will involve reconstruction, as was attempted after American Civil War I and, in Europe and Japan after WW II. It may or may not require or involve explicit constitutional amendments. 5/

Reconstructions involve extraordinary measures, not necessarily intended to be permanent. They can be done better or worse, more or less fully. But if the American Pro-Democracy side wins, it should not expect or pursue “normal” politics and law once it controls the Congress and the executive branch. 6/

The federal judiciary, especially the federal appellate courts, and the Supreme Court will have to be overhauled. A host of constraints on the executive branch will have to legislated, enacted, and implemented. 7/

The Department of Homeland Security will have to be eliminated and replaced by smaller, more clearly defined and constrained Cabinet department and subordinate agencies. A host of post-9/11 laws will have to be repealed.8/
