"The 7 french comrades arrested on 8 December 2020 will go on trial from 3 to 27 October 2023. They will be judged for «criminal association of terrorist criminals» (art. 450-1) in Paris. No terrorist project has been established after two years of investigation characterized by the use of white torture and a very intrusive surveillance. The criminal classification was not retained but the terrorist and collective dimension remains despite the total absence of evidence or even links between all the seven people. Several of them are also charged with “refusing to surrender a secret decryption convention” (Art. 434-15)."

"The recurrent mobilization of anti-terrorist investigative resources to repress social movements, combined with the dissemination of unequivocal language – “ecoterrorism”, “intellectual terrorism” – leave no room for doubt.
The aim is to confuse terrorism with social struggles, so as to prepare public opinion for the fact that the perpetrators of political illegalism will soon be charged with terrorism. And to give free rein to political repression, by giving it the benefit of the most complete repressive arsenal the law offers today: anti-terrorist legislation.
It is against this backdrop that the first trial of leftist activists for “terrorism” since the Tarnac affair [1] will take place in October. The stakes are high. A sentence would legitimize the government’s repressive shift. It is the symbolic dividing line between what can and cannot be qualified as terrorism that the government is seeking to shift in this trial."

“8 December” case: why is encryption on trial?
"On 3 October, the trial of the so-called “8 December” case began. Seven people are prosecuted for being a “terrorist group”.

The intelligence services in charge of the judicial investigation (Direction générale de la Sécurité intérieure, DGSI), the National Antiterrorist Prosecution Office (Parquet National Antiterroriste, PNAT), and the investigating judge based their case on the fact that the defendants were using different tools to protect their privacy and encrypt their communications on a daily basis.

This trial is part of an increased political push by states and law enforcement for surveillance measures and the criminalisation of encryption. That is why the trial is crucial in the battle against the state’s ongoing attempts to criminalise commonplace, secure and healthy digital practices.

"In einem Verfahren mit bislang wenigen Beweisen versuchen französische Ermittlungsbehörden die Nutzung von weit verbreiteten Verschlüsselungstechniken als Beleg für klandestines Verhalten heranzuziehen.

Auch würde mit der Betonung angeblich großer Computerkompetenz, die zum Beispiel damit begründet wird, dass ein Verdächtigter das Betriebssystem #Linux mit Verschlüsselung auf seinem Computer installiert habe, ein „alarmierendes Narrativ“ konstruiert, so La Quadrature. Handschriftliche Notizen zur Installation alternativer Handy-Betriebssysteme oder zur Nutzung der Videokonferenzsoftware #Jitsi bestätigten laut der Akte „den Wunsch von X, in den Untergrund zu gehen und ihre Aktivitäten zu verbergen“. Einem Verdächtigen wird laut den Akten vorgehalten, dass er seine Mutter zur Nutzung von Signal überzeugt hätte. Zu den Fragen, die sich die Verdächtigen anhören mussten, gehörte laut Quadrature auch, ob die Verdächtigen gegen Google, Apple, Facebook und Amazon (GAFA) seien."
