    No, Trump does not have the legal authority or the practical ability to “nationalize” US elections, for all the same reasons he also didn’t when he issued an executive order a few months ago abolishing mail in voting. Elections are governed by states, and, to a limited extent, Congress. Not the executive branch.

    There are plenty of very real, immediate threats to democracy to get worked up about right now. This isn’t one of them.

    @mattblaze I don't have the legal authority to drive 75 in a 60 mph zone, but if nobody writes the ticket, I get away with it.

      @lastofthem @dominykas You know what’s *really* dangerous and full of privilege? Ignoring the details of how complex things you don’t actually understand(like how US elections work) work in order to make dramatic but unwarranted pronouncements of doom.

          @hellomiakoda but if your car can’t go 75, you can’t do itnin the first place. And there is simply no mechanism through which a US president can nationalize US elections, which are run by state and local governments.

            @mattblaze @diasyy11 he may have no legal way to do it but that's never stopped him before...

            as far as practical ability, i mean he now has a private army that answers to no one but himself called ICE that's larger and better funded than the marine corps... so i don't think it's correct to say he has no practical ability any more.

                    @mattblaze @diasyy11 i don't have to be an elections expert to understand that if a bunch of guys with guns show up and start beating people up and shutting down the polling station or seizing the machines, that nothing in the law can stop that and in a situation like minneapolis where the cops are outnumbered 5:1 by ICE guys with bigger guns, nothing in local law enforcement can stop it either.

                        @mattblaze @diasyy11 i'm not freaking out about it and i don't think it's particularly likely but at the same time i think completely ruling it out from a guy who sent his followers to their deaths with lies on january 6th just bc he couldn't handle losing power is foolish.

                          @mattblaze @diasyy11 p.s. the last thing i heard him say wasn't that he needed to nationalize elections, but that he thought they will need to commandeer the election machinery in just 15 places that he deems problematic. that was a few hours ago.

                          15 places is well within ICE's budget.

But after all the Epstein files and a failure to punish attempted coup on previous term (to name just two examples), can we still say that law actually works? I think people here are concerned that the Orange will bypass the law through force, not that he can do it legally. 🤷‍♂️

                                      I could go into detail about what the limits on executive and federal control over US elections are, and what the president could do to exert influence over them, but it would be extremely tedious and irrelevant to the actual reality here, which is that this is a nothing burger.

                                      Most ballot questions are for state and local offices and initiatives

                                      ~ 5000 local election administration jurisdictions (mostly counties and townships), which run election logistics

                                      ~ 115,000 local polling places, mostly borrowed for election day

                                      ~ 750,000 election day workers

                                      ~ 138,000,000 ballots cast in 2016, 82,000,000 of which at local polling places on election day.

                                          @mattblaze @diasyy11 Save for the fact that that won't necessarily stop him, enough GOP state governments would go along to make it successful, and he'll appeal any TROs or PIs to the Supreme Court with the risk they'll overturn those TROs/PIs on the shadow docket regardless of logic or lack thereof (look at all the otherwise completely non-controversial TROs/PIs they've done that with in the last year).
